Terms of Service & End User License Agreement (EULA)

These Terms of Service and End User License Agreement (the "Terms") govern your use of the dajno mobile application and related services ("dajno", "the app", "we", "us", or "our"). dajno is a gym-agnostic social indoor-bouldering app: climbers photograph routes, log sends, follow friends, and post sessions. dajno is operated by a solo developer (the "operator"), Julian Guttmann, contactable at support@dajno.app.
Please read these Terms carefully. They include a zero-tolerance policy for objectionable content and conduct (Section 4), disclaimers of warranties (Section 11), and a limitation of liability (Section 12).
1. Acceptance of these Terms
By creating an account, accessing, or using dajno, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the app. If you use the app on behalf of another person, you confirm you are authorized to bind them to these Terms.
2. Eligibility (16+)
You must be at least 16 years old to use dajno. By creating an account, you represent and confirm that you are 16 or older and that you have the legal capacity to enter into these Terms. The app is not directed to children under 16. If we learn that a user is under 16, we may suspend or terminate the account.
3. Your account and responsibilities
- You are responsible for the accuracy of the information you provide and for all activity that occurs under your account.
- Keep your login credentials confidential. Notify us promptly at support@dajno.app if you suspect unauthorized access.
- You may not impersonate others, create accounts for abusive purposes, or share your account in a way that violates these Terms.
- You are responsible for your own safety. Indoor bouldering and climbing are inherently risky physical activities; dajno is an informational and social tool only and is not a substitute for proper training, supervision, gym rules, or safety equipment.
4. Objectionable Content & Conduct — Zero Tolerance
dajno has ZERO TOLERANCE for objectionable content and abusive users. This Section is fundamental to your use of the app.
4.1 No objectionable content or conduct
You may not post, upload, share, or transmit any content, and you may not engage in any conduct, that is objectionable, including content or behavior that is:
- abusive, harassing, bullying, threatening, or intimidating;
- hateful or discriminatory (including on the basis of race, ethnicity, national origin, religion, sex, gender, gender identity, sexual orientation, disability, or age);
- sexually explicit, obscene, or pornographic;
- violent, or that promotes self-harm or harm to others;
- illegal, or that promotes illegal activity;
- infringing of any third party's intellectual property, privacy, or other rights;
- spam, fraudulent, deceptive, or otherwise harmful.
4.2 Reporting and blocking — built into the app
- Report content: Every user can report objectionable content from within the app.
- Block users: Every user can block another user from within the app to stop further interaction.
- Report abuse to us directly: You can also report objectionable content or abusive users by emailing support@dajno.app.
4.3 Our response — action within 24 hours
We act on reports of objectionable content and abusive users within 24 hours. When we determine that content or conduct violates this Section, we will take action, which may include removing the offending content and/or ejecting (suspending or terminating) the responsible user from the app. We may take these actions at our discretion and without prior notice where appropriate to protect users.
By using dajno, you agree to this zero-tolerance policy, the in-app reporting and blocking tools, and our right to remove content and eject users as described above.
5. User-generated content: license and responsibility
- You own your content. You retain ownership of the content you create or upload (including route photos, avatars, bios, and climbing activity).
- License to us. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your content solely to operate, provide, and improve dajno and to make it available within the app as you direct (for example, publicly to other users). This license ends when you delete the content or your account, except for content that has been shared with others and copies retained in routine backups (which roll off per our provider's policy) and de-identified/append-only records as described in our Privacy Policy.
- Your responsibility. You are solely responsible for the content you post and confirm that you have the rights to post it and that it does not violate these Terms (including Section 4) or any law or third-party right. Do not photograph or post images of other people without an appropriate basis to do so.
6. Acceptable use — prohibited conduct
In addition to Section 4, you agree not to:
- violate any applicable law or regulation;
- infringe anyone's intellectual property, privacy, publicity, or other rights;
- access the app or its systems without authorization, or attempt to bypass Row-Level Security or other access controls;
- probe, scan, or test the vulnerability of the app or interfere with its operation, or introduce malware;
- scrape, harvest, or collect data about users except as permitted by these Terms;
- use bots or automated means to create accounts, post content, or interact with the service, except as expressly permitted;
- reverse engineer, decompile, or disassemble the app except to the extent that this restriction is prohibited by applicable law;
- resell, sublicense, or commercially exploit the app or its content without our written permission;
- misrepresent your identity or affiliation, or post misleading information; or
- encourage or enable any third party to do any of the above.
7. License to use the app (EULA)
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use dajno on devices you own or control, for your personal, non-commercial use. We retain all rights, title, and interest in and to the app and its software, branding, and content (other than your user content). This license is also subject to the rules of the platform from which you obtained the app (e.g., the Apple App Store or Google Play).
8. Enforcement, suspension, and termination
We may, at our discretion and to the extent permitted by law, suspend or terminate your access to dajno, remove content, or eject users if you violate these Terms (including Section 4), if required by law, or to protect the app or its users. Where reasonable and not detrimental to other users, we will aim to provide notice. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and governing law) will survive.
9. Account deletion
You can delete your account at any time:
- In the app, via the account deletion feature; or
- Online, at https://dajno.app/delete-account.
On deletion, your personally identifying information is anonymized or removed and your uploaded photos are deleted, as described in our Privacy Policy. Append-only climbing records may be retained in de-identified form.
10. Changes to the app
We are actively developing dajno and may add, change, or remove features, or discontinue the app, at any time. We are not liable to you for any modification, suspension, or discontinuation of the app, except as required by law.
11. Disclaimers and warranties
To the maximum extent permitted by law, dajno is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that any content (including gym, route, or grade information) is accurate, complete, or reliable. You use the app, and engage in climbing activity, at your own risk.
Nothing in these Terms excludes or limits any rights you have that cannot be excluded or limited under applicable law (including mandatory consumer-protection rights).
12. Limitation of liability
To the maximum extent permitted by law, the operator will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) dajno, even if advised of the possibility of such damages.
To the maximum extent permitted by law, the operator's total aggregate liability for all claims relating to the app will not exceed the greater of (a) the amount you paid us, if any, for the app in the 12 months before the claim, or (b) USD 50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing here limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or for fraud).
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless the operator from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your content, your use of the app, or your violation of these Terms or any law or third-party right.
14. Governing law and jurisdiction
These Terms are governed by Poland, without regard to its conflict-of-laws rules. The courts located in Poland will have jurisdiction, except where mandatory law (such as consumer-protection law in your country of residence) gives you the right to bring proceedings, or requires proceedings to be brought, elsewhere.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the Effective date above and, where appropriate, provide notice in the app. The current version is always available at https://dajno.app/terms. Your continued use of dajno after changes take effect constitutes acceptance of the updated Terms, to the extent permitted by law.
